TENS Machine Hire – Terms & Conditions

These Terms & Conditions (“Terms”) apply to all Labour TENS machine hires provided by One Mama Midwife (ABN: 66663734398), trading as The Mama HQ (“we”, “our”, “us”). By placing a booking, you (“you”, “the hirer”, “the customer”) agree to the following:

1. Hire Period & Delivery

1.1 The standard hire period is based on the selected hire duration (6 or 8 weeks), starting from the “Start Date” you selected at checkout or confirmed by us in writing.
1.2 Your TENS machine is scheduled for dispatch to arrive on the selected date.
1.3 The hire period ends on the final day of the agreed duration. The TENS machine, lanyard, lead wires and The Mama HQ Bag must be returned by this date using the prepaid satchel provided (or via agreed alternative return method).
1.4 Delayed arrival due to postal delays outside our control does not automatically extend the hire period unless agreed in writing.

2. Extensions

2.1 If your baby has not arrived or you require additional time, extension options may be available (subject to availability).
2.2 Extension fees are payable in advance and must be confirmed before your original return date.

3. Hiring Fee & Payment

3.1 Full payment is required at the time of booking.
3.2 Hire fees are non-transferable and apply per machine.
3.3 Credit or debit card details may be securely stored for potential late or damage fees (see Section 6).

4. Refunds & Cancellations

4.1 If you cancel before the TENS machine has been dispatched, you may receive a refund minus a $10 administration fee.
4.2 Once dispatched, no refunds will be issued, excluding in the event your baby arrives early or you do not to use the machine. In this case you will receive a refund of the full amount minus postage fees if the Electrodes have not been opened and after the machine has been inspected.

5. Machine Condition, Care & Hygiene

5.1 Each TENS machine is professionally cleaned, tested and supplied with brand-new, single-use electrode pads for hygiene.
5.2 You agree to use the machine only as directed in the user manual and not to subhire or lend it to others.
5.3 You must keep the machine clean, dry, and free from damage, and ensure it is stored safely when not in use.
5.4 The electrode pads are for single-user use only and must not be returned with the machine.

6. Loss, Damage & Late Returns

6.1 If the machine is lost, damaged, or not returned, replacement fees will be charged as follows:
Machine replacement: $230
Lead wires: $22
Lanyard: $10
Mama HQ case: $20
6.2 A late fee of $10 per week may apply if the machine is not returned by the due date without prior written agreement.
6.3 Replacement or late fees will be charged to the original payment method unless an alternative payment is arranged.

7. Usage & Safety

7.1 You acknowledge that:
- TENS machines provide pain relief support but do not guarantee full pain elimination.
- TENS should not be used in water or near moisture.
- TENS is generally not used if you have a pacemaker, epilepsy, or certain medical conditions unless advised by a healthcare professional. Always check with your healthcare provider before use
- TENS Machines should not be used until after 37 weeks in the pregnancy
7.2 You agree to stop using the device immediately and seek medical advice if you feel dizzy, unwell, or experience abnormal discomfort.
7.3 Always consult your midwife, obstetrician, GP or health professional if unsure about TENS suitability.
7.4 We accept no liability for misuse or failure to follow the instructions provided.

8. Medical Disclaimer

8.1 Our team includes registered midwives, however, hiring a TENS machine through us does not constitute medical advice or a substitute for individualised care.
8.2 Always follow guidance from your healthcare provider and use the TENS device as an adjunct to recommended pain relief strategies.

9. Liability

9.1 We are not liable for:
- Pain levels experienced during labour
- Failure of the machine to meet personal expectations
- Reactions to electrode pads
- Delays in postal services
9.2 To the maximum extent permitted by law, we are not responsible for personal injury, loss, damage or expense arising from the hire or use of the TENS machine.

10. Australian Consumer Law

10.1 These Terms do not exclude your rights under Australian Consumer Law. If the product is faulty upon arrival, please contact us within 24 hours for a replacement or resolution.

11. Agreement

By completing a booking, you confirm that:
- You are 18+ years old or have consent
- You understand and accept these Terms
- You accept responsibility for the TENS machine during the hire period
- You consent to reasonable charges for late return, damage or loss
